Adult-use marijuana is legal in 21 states, including Pennsylvania's neighbors Maryland, New Jersey and New York. The substance remains illegal in Pennsylvania, although the governor is proposing to legal and tax adult-use marijuana as part of his 2023-2024 budget request. According to NORML, or National Organization for the Reform of Marijuana Laws, 12 Pennsylvania municipalities have decriminalized marijuana, which means that possession of small amounts of the drug will not result in criminal charges.

Under Pennsylvania state law, someone who possesses 30 grams or less of marijuana can be charged with a misdemeanor and face a maximum of 30 days in jail and a fine of $500. After the state legal medical marijuana back in 2016, Pennsylvania has seen a long and slow arc toward accepting what many see as an important form of medicine. Some progress has been made, including the passage of a law that allows medical marijuana to be used as an alternative to opioids, and the state has also adopted a medical marijuana program.

As part of his 2023-24 budget, Pennsylvania Gov. Josh Shapiro has proposed taxing legal, adult-use marijuana at a rate that is projected to generate $188 million in revenue for the state. The governor has also proposed creating a Cannabis Regulatory Board to oversee the newly-legal marijuana industry in the state.

Although a measure to legal recreational cannabis in Pennsylvania has a chance to pass the state Legislature, lawmakers said they first need to address the issue of home cultivation. Pennsylvania is one of the few states that doesn’t allow home cultivation of marijuana, even for medical use. The state has also been slow to approve more dispensaries and has imposed strict regulations on medical marijuana use.

Pennsylvania's medical marijuana program has had some hiccups over the years. In 2019, the state's medical marijuana program was found to be falling short of the state's expectations, with fewer than 20 percent of patients taking part in the program. The state has also had difficulty approving more dispensaries and has imposed strict regulations on medical marijuana use.

In an effort to make the medical marijuana program more accessible, Pennsylvania has passed a law that allows medical marijuana to be used as an alternative to opioids. This law was designed to reduce the number of opioid-related deaths in the state and give patients an alternative to prescription painkillers.

Pennsylvania is one of only a few states that doesn’t allow home cultivation of marijuana, even for medical use. This means that the only way for patients to access medical marijuana is through the state-approved dispensaries. This has led to some frustration from medical marijuana users, who have complained that the limited number of dispensaries makes it difficult for them to access the medicine they need.
