Marijuana remains illegal in Texas despite efforts to legalize it. In 2015, a law was passed allowing low-level THC cannabis oil to be used as a treatment for epilepsy. In 2019, a bill was introduced to allow counties and municipalities to legalize recreational marijuana at the local level. However, this bill failed to pass the Texas House of Representatives.
Currently, marijuana possession is classified as a Class B misdemeanor in Texas. This means that possession of small amounts of cannabis can result in up to 180 days in jail and/or a fine of up to $2,000. possession of larger amounts of marijuana is considered a felony, and can result in more severe punishment.
Additionally, because recreational marijuana is illegal in Texas, companies may test their employees for marijuana use. This means that if an employee tests positive for cannabis, they may face disciplinary action, including possible termination.
